1. Acceptance of Terms

By accessing and using Moviq's website and platform, you accept and agree to be bound by the terms and provision of this agreement.

2. Account & Trial Terms

By creating an account or joining:

• You consent to receive updates about Moviq's features and services
• You understand that joining the waitlist does not guarantee access to the product
• You may receive marketing communications related to Moviq
• You can unsubscribe from communications at any time

3. Use of Information

Information provided through our waitlist form will be used to:

• Communicate product updates and launch information
• Provide early access opportunities
• Improve our product based on user feedback
• Conduct market research (anonymized data only)

3a. WhatsApp Messaging — User Responsibility for Consent

Moviq sends WhatsApp messages on your behalf using the official WhatsApp Business API. By using Moviq to send messages, you agree to the following:

• You are solely responsible for obtaining valid consent from your customers before messaging them through Moviq. This includes confirming that they have agreed to receive WhatsApp reminders from your business.
• You must only upload contacts of customers who have an existing relationship with your business and have provided valid consent to receive payment-related communications from your business.
• You must not use Moviq to send unsolicited, bulk, promotional, or spam messages of any kind.
• You must honour opt-out requests promptly and not re-add customers who have unsubscribed.
• Failure to comply with these obligations may result in immediate account suspension and reporting to Meta/WhatsApp.

Moviq operates strictly as a transactional messaging platform. Any misuse that violates WhatsApp's Business Policy or India's TRAI regulations is the sole responsibility of the business owner using the platform.

3b. Protection of Minors (Tuition & Academy Accounts)

If you operate a tuition center, school, coaching academy, or kids' training institute where services are provided to minors (individuals under 18 years of age):

• You warrant that all phone numbers entered into Moviq belong to the parent or legal guardian of the minor.
• You must not direct commercial or payment-related messages to a minor's personal device without verified parental authorization.

4. Prohibited Uses

You may not use Moviq or our website for:

• Any unlawful purpose or to solicit others to perform unlawful acts
• Cold outreach, prospecting, or lead generation
• Messaging contacts from purchased, rented, scraped, harvested, or third-party databases
• Promotional, marketing, or bulk messaging campaigns
• Gambling, adult content, cryptocurrency investment schemes, multi-level marketing, payday lending, or deceptive financial offers
• Debt collection harassment, threats, or abusive communication
• Violating any applicable regulations, laws, or local ordinances
• Infringing upon intellectual property rights
• Submitting false or misleading information

4a. Messaging Compliance & Reasonable Hours

Users must comply with all applicable WhatsApp Business Platform policies, telecommunications regulations, privacy laws, and consent requirements.

• Reasonable Hours Policy: In alignment with Indian consumer protection and TRAI guidelines, automated payment reminders should be scheduled during reasonable daytime hours (between 8:00 AM and 8:00 PM IST).
• Immediate Opt-Out: Any end-user replying "STOP" must be excluded from future automated dispatches.

Moviq reserves the right to suspend or terminate accounts that generate excessive complaints, blocks, spam reports, or policy violations on any messaging channel.

4b. Free Trial & Subscription Terms

All new accounts are granted a 45-Day Free Trial with zero credit card commitment. Details regarding paid plan renewals, cancellations, and refunds are outlined in our dedicated Refund & Cancellation Policy.

5. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Moviq and its licensors. The service is protected by copyright, trademark, and other laws.

6. Disclaimer

The information and software on this website are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Moviq excludes all representations, warranties, conditions, and terms related to our software and its uptime.

6a. Pure Software Utility & Non-Payment Aggregator Status

Moviq operates solely as a Technical Service Provider (TSP) providing software automation and communication tools. By using this service, you acknowledge and agree that:

• Moviq is not a payment aggregator (PA), payment gateway (PG), bank, NBFC, or financial intermediary under the Reserve Bank of India (RBI) regulations.
• Moviq never holds, escrows, receives, processes, or routes funds. All payment transactions occur directly peer-to-peer between your customer and your own bank account via standard NPCI UPI URI protocols.
• Moviq does not independently verify bank account settlements or UPI transaction validity. The verification of payment receipts and UTR numbers is the sole responsibility of the business owner.
• Moviq carries zero liability for any payment failures, bank downtimes, incorrect UPI IDs entered by the merchant, or commercial disputes between you and your customers.

7. Limitation of Liability

In no event shall Moviq, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the website.

8. Governing Law

These terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
